Terms and Conditions - Blue Diamond Entertainment

Introduction

These Terms and Conditions ("Terms") govern the provision of entertainment services by Blue Diamond Entertainment ("we", "us", or "our") to clients ("you" or "the Client") for weddings, parties, corporate events, and other celebrations.

By booking our services, you agree to be bound by these Terms. Please read them carefully before making a booking.

1. Services Provided

1.1 Our Services

Blue Diamond Entertainment provides professional event entertainment services including:

  • Wedding DJ services

  • Party and event DJ services

  • Nightclub and bar DJ services

  • Photo booth hire (360°, magic mirror, digital selfie pod, rustic, traditional)

  • Special effects (Dancing on Clouds dry ice, cold spark fountains)

  • Visual décor hire (LED dance floors, flower walls, neon signs, LOVE letters, balloon arches)

  • Silent disco hire

  • Mini golf hire

  • Outdoor cinema screen hire

  • Wooden illuminated letters and numbers

1.2 Service Specifications

All services are subject to availability and will be confirmed in writing upon booking. Specific equipment models, sizes, and configurations will be detailed in your booking confirmation.

2. Booking Process

2.1 Enquiries and Quotations

All quotations are valid for 14 days from the date of issue unless otherwise stated. Quotations are not binding until a booking is confirmed in accordance with Section 2.3.

2.2 Provisional Bookings

We may hold a provisional booking for up to 7 days to allow you time to secure your date. Provisional bookings are not confirmed until a deposit is received.

2.3 Confirmed Bookings

A booking is confirmed when:

  • You have returned a signed booking agreement (contract)

  • The required deposit has been received

  • We have issued written confirmation of your booking

Once confirmed, these Terms form a legally binding contract between you and Blue Diamond Entertainment.

2.4 Booking Amendments

We will make reasonable efforts to accommodate changes to your booking, subject to availability. Changes must be requested in writing at least 28 days before the event date. Additional charges may apply for significant amendments.

3. Payment Terms

3.1 Deposit

A non-refundable deposit of £100-£200 (or 25% of the total booking value, whichever is greater) is required to secure your booking. The deposit amount will be specified in your quotation.

3.2 Balance Payment

The full balance must be paid no later than 14 days before your event date. We reserve the right to cancel the booking if payment is not received by the due date.

3.3 Payment Methods

We accept payment by:

  • Bank transfer (BACS)

  • Credit/debit card

  • PayPal

  • Cash (by arrangement)

3.4 Additional Charges

Additional charges may apply for:

  • Last-minute booking changes

  • Extended event times beyond the agreed finish time (£50 per hour or part thereof)

  • Additional travel for venues outside our standard service area

  • Excessive setup/breakdown delays caused by venue or client

  • Damage to equipment (see Section 9.4)

3.5 Late Payments

Late payments may incur interest charges at 8% above the Bank of England base rate per annum, calculated daily from the due date until payment is received.

4. Cancellation and Refunds

4.1 Cancellation by Client

If you cancel your booking, the following charges apply:

  • More than 90 days before event: Deposit forfeited

  • 61-90 days before event: 50% of total booking value

  • 31-60 days before event: 75% of total booking value

  • 30 days or less before event: 100% of total booking value (no refund)

All cancellations must be made in writing via email.

4.2 Rescheduling

If you need to reschedule your event, we will make every effort to accommodate your new date subject to availability. Rescheduling requests made:

  • More than 60 days before event: No additional charge (deposit transfers to new date)

  • 31-60 days before event: £50 administration fee

  • 30 days or less before event: Treated as a cancellation (see Section 4.1)

If we cannot accommodate your new date, standard cancellation terms apply.

4.3 Cancellation by Blue Diamond Entertainment

We reserve the right to cancel a booking in exceptional circumstances. If we cancel, you will receive a full refund of all payments made, but we will not be liable for any consequential losses or expenses.

5. Client Responsibilities

5.1 Event Information

You must provide accurate and complete information about your event, including:

  • Event date, start time, and expected finish time

  • Venue name, full address, and access details

  • Estimated number of guests

  • Specific requirements or requests

  • Any venue restrictions or limitations

5.2 Venue Coordination

You are responsible for:

  • Confirming we have permission to provide services at your chosen venue

  • Ensuring the venue can accommodate our equipment and setup requirements

  • Coordinating load-in and setup times with the venue

  • Providing adequate power supply and access to electrical outlets

  • Ensuring a safe working environment for our team

5.3 Music Planning

For DJ services, you should:

  • Complete our online music planning system at least 14 days before your event

  • Provide a first dance song and any special requests

  • Inform us of any "do not play" songs or genres

  • Understand that we cannot guarantee availability of every specific song request

5.4 Photo Booth Usage

For photo booth services, you are responsible for:

  • Ensuring guests use equipment respectfully and safely

  • Supervising minors using the equipment

  • Any damage caused by guests (see Section 9.4)

6. Venue Requirements and Access

6.1 Load-In and Setup

We require access to the venue for setup at least 2-3 hours before the event start time (specific timing will be confirmed in writing). Delayed access may impact setup quality or event start time.

6.2 Space Requirements

You must ensure adequate space is available for our equipment:

  • DJ setup: Minimum 2m x 2m area with access to power

  • Photo booths: Space requirements vary by type (2m x 2m to 3m x 3m)

  • LED dance floor: As per size selected (e.g., 12ft x 12ft, 16ft x 16ft)

  • Flower walls: 8ft x 8ft floor space minimum

  • Other décor: As specified in booking confirmation

6.3 Power Supply

  • Standard 13-amp UK power sockets required within 10 meters of setup area

  • Multiple sockets may be needed depending on package

  • Power must be available during entire setup, event, and breakdown periods

6.4 Venue Restrictions

You must inform us of any venue restrictions including:

  • Sound limiters or noise restrictions

  • Access limitations (stairs, narrow doorways, load-in restrictions)

  • Curfews or strict finish times

  • Restrictions on confetti, dry ice, or special effects

  • PAT testing or insurance requirements

6.5 Outdoor Events

For outdoor events, you must provide:

  • Covered area for equipment protection (gazebo, marquee, or indoor backup)

  • Protection from adverse weather conditions

  • Safe and level ground surface

  • Extension leads if power source is distant

We reserve the right to refuse setup or discontinue services if conditions are unsafe for equipment or staff.

7. Performance and Service Delivery

7.1 Professional Standards

We will:

  • Arrive punctually for setup at the agreed time

  • Provide fully PAT-tested, safe, and insured equipment

  • Deliver services professionally and in accordance with your booking

  • Dress appropriately for your event (smart/professional attire)

  • Work courteously with venue staff, other suppliers, and guests

7.2 Equipment Performance

While we maintain our equipment to high standards, technical issues can occasionally occur. If equipment failure prevents service delivery, we will:

  • Attempt to resolve the issue promptly

  • Provide backup equipment where available

  • Offer a partial refund proportionate to the disruption

We are not liable for minor technical issues that do not significantly impact your event.

7.3 Music Selection and Performance

Our DJs are experienced professionals who will:

  • Play music appropriate to your event and preferences

  • Read the crowd and adjust music selection accordingly

  • Honor reasonable requests from you and your guests

  • Maintain energy and atmosphere throughout the event

We reserve the right to decline requests for inappropriate content or music we do not have available.

7.4 Event Timing

Events must finish at the time specified in your booking. If you wish to extend beyond this time:

  • Request must be made on the day (subject to DJ/staff availability)

  • Venue must permit the extension

  • Additional charges apply (£50 per hour or part thereof, payable on the day)

  • We cannot guarantee extensions are possible

8. Photography and Marketing

8.1 Event Photography

Our staff may take photographs of equipment setups, guest interactions, and general event atmosphere for our portfolio and marketing purposes.

8.2 Use of Images

By booking our services, you grant us permission to:

  • Photograph our equipment and services at your event

  • Use these images on our website, social media, and marketing materials

  • Feature your event as a case study (venue and first names only, unless otherwise agreed)

8.3 Opting Out

If you do not wish your event to be photographed or used in marketing materials, you must inform us in writing at the time of booking. This will not affect your booking.

8.4 Guest Photos

Photos taken by guests using our photo booths:

  • Remain the property of the guests and the Client

  • May be shared via our digital sharing platforms

  • We retain copies for technical purposes only (not for marketing)

  • Will be deleted within 90 days unless otherwise requested

9. Liability and Insurance

9.1 Our Insurance

We maintain:

  • Public Liability Insurance (minimum £10 million)

  • Professional Indemnity Insurance

  • Employers' Liability Insurance

  • Equipment Insurance

Certificates of insurance can be provided to venues upon request.

9.2 Our Liability

We accept liability for:

  • Personal injury or death caused by our negligence

  • Damage to property caused by our negligence

  • Breaches of contract that significantly affect your event

Our total liability is limited to the value of your booking, except where UK law prevents such limitation (e.g., personal injury claims).

9.3 Our Exclusions

We are not liable for:

  • Minor technical issues that do not significantly disrupt your event

  • Delays or issues caused by the venue, other suppliers, or circumstances beyond our control

  • Loss of opportunity or disappointment

  • Indirect or consequential losses

  • Issues arising from your failure to provide accurate information or meet your responsibilities

9.4 Client Liability

You are liable for:

  • Any damage to our equipment caused by you, your guests, or other suppliers

  • Loss or theft of our equipment while at your event

  • Costs incurred due to inaccurate information or failure to meet agreed responsibilities

Damage charges will be assessed based on repair or replacement costs.

10. Force Majeure

10.1 Unforeseen Circumstances

Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including:

  • Natural disasters (extreme weather, flooding, etc.)

  • Pandemic or government restrictions

  • Venue closure or cancellation

  • Serious illness or injury of key personnel

  • Transport failures preventing attendance

  • Acts of terrorism or civil unrest

10.2 Notification

If a force majeure event occurs, the affected party must notify the other party as soon as reasonably possible.

10.3 Remedies

In force majeure situations:

  • We will attempt to provide alternative staff or equipment where possible

  • Rescheduling will be offered without penalty (subject to availability)

  • If rescheduling is not possible, a full refund of payments made will be provided

  • Neither party is liable for consequential losses

11. Intellectual Property

11.1 Music Licensing

We hold appropriate licenses for public performance of music (PRS for Music, PPL). You do not need to arrange separate music licenses for our DJ services.

11.2 Our Content

All content on our website, marketing materials, and branding is owned by Blue Diamond Entertainment and protected by intellectual property laws. You may not reproduce or use this content without our written permission.

11.3 Your Content

Any music, images, or content you provide for your event remains your property. You grant us a license to use this content solely for delivering your event services.

12. Data Protection

Your personal information is processed in accordance with our Privacy Policy and UK GDPR requirements. By booking our services, you consent to our collection and use of your data as described in our Privacy Policy.

13. Complaints Procedure

13.1 During Your Event

If any issues arise during your event, please speak to our staff member on site immediately so we can address the problem in real-time.

13.2 Post-Event Complaints

If you wish to make a formal complaint:

  1. Contact us in writing within 7 days of your event

  2. Provide specific details of the issue

  3. Include any supporting evidence (photos, videos, witness statements)

  4. State your desired resolution

We will:

  • Acknowledge your complaint within 2 working days

  • Investigate the matter thoroughly

  • Provide a written response within 14 days

  • Work with you to reach a fair resolution

13.3 Dispute Resolution

If we cannot resolve a complaint to your satisfaction, you may refer the matter to an independent Alternative Dispute Resolution (ADR) provider or seek legal advice.

14. Subcontracting

14.1 Right to Subcontract

We reserve the right to use subcontracted DJs, photographers, or other professionals to fulfill your booking. All subcontractors are:

  • Experienced and qualified professionals

  • Fully briefed on your event requirements

  • Covered by our insurance and professional standards

  • Vetted and approved by Blue Diamond Entertainment

14.2 Named Performers

If you have booked a specific named DJ or entertainer, we will make every effort to ensure they perform at your event. If they become unavailable due to illness or emergency:

  • We will provide a suitable replacement of equivalent experience

  • You will be notified as soon as possible

  • If you are not satisfied with the replacement, you may cancel without penalty (full refund)

15. Health and Safety

15.1 Equipment Safety

All our equipment is:

  • Regularly maintained and serviced

  • PAT tested annually

  • Operated in accordance with manufacturer guidelines

  • Set up with appropriate safety measures (cable management, equipment stability, etc.)

 

15.2 Special Effects Safety

For special effects services (dry ice, cold spark fountains):

  • Effects are operated by trained professionals

  • We comply with all health and safety regulations

  • We will conduct a venue risk assessment

  • Venue approval and insurance confirmation may be required

  • We reserve the right to refuse setup if conditions are unsafe

15.3 COVID-19 and Infectious Diseases

We follow current government guidance regarding infectious disease control. If specific measures are required at the time of your event, we will discuss these with you in advance.

16. General Terms

16.1 Entire Agreement

These Terms, along with your booking confirmation and any written amendments, constitute the entire agreement between you and Blue Diamond Entertainment.

16.2 Variations

Any variations to these Terms must be agreed in writing by both parties.

16.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.

16.4 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it later.

16.5 Assignment

You may not transfer or assign your booking to another party without our written consent. We may assign our obligations to a qualified subcontractor (see Section 14).

16.6 Third Party Rights

These Terms are between you and Blue Diamond Entertainment only. No third party has rights to enforce any provision under the Contracts (Rights of Third Parties) Act 1999.

 

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Acceptance

By booking our services, you confirm that you:

  • Have read and understood these Terms and Conditions

  • Agree to be bound by these Terms

  • Have authority to enter into this agreement

  • Have provided accurate and complete information
